20 Year-old College student in San Jose California Tased and Beaten by Police

Did four campus police officers use excessive force by using Taser guns and batons in the course of arresting a student? Phuong Ho, a San Jose State University student, had been accused of assault against another student in early September.   Reportedly, police responded to the location and attempted to arrest Ho.  However, although unarmed, Ho was repeatedly beaten by at least four officers.  The incident is being investigated and could result in disciplinary action against the officers and/or a civil action by the San Jose college student.   

The beating incident was videotaped by another student on a cell phone.  At least two officers have been temporarily suspended pending further investigation.


Use of excessive force by police officers could give rise to a civil action for violations of a private citizen’s civil rights under the United States Constitution.  If proven that Ho’s rights were violated, the University Police could be held accountable for Ho’s medical bills or monetary damages and may be ordered to pay punitive damages also.
